1. Acceptance of Terms

By accessing or using TaxWiseTrader (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.

2. Description of Service & Disclaimers

TaxWiseTrader provides portfolio tracking, FIFO-based capital gains calculation, tax analytics, and trading metrics for Indian equity traders. The Platform is a financial analytics tool only.

⚠️ NO INVESTMENT OR FINANCIAL ADVICE: We are NOT a SEBI (Securities and Exchange Board of India) registered investment advisor, research analyst, or portfolio manager. We do not provide buy/sell recommendations, stock tips, investment advice, or trading recommendations of any kind. Any data, analytics, or charts displayed on the Platform are for informational purposes only.

⚠️ NO TAX ADVICE: The calculations provided by the Platform do not constitute official tax audits or legal advice. Always consult a qualified Chartered Accountant (CA) or tax professional before filing tax returns. You are solely responsible for ensuring the accuracy and compliance of your filings with the Income Tax Department of India.

3. Eligibility

You must be at least 18 years old and legally capable of entering into contracts under Indian law to use this Platform. By registering, you represent that you meet these requirements.

4. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised access.

5. Data Accuracy

The Platform calculates tax and P&L figures based on trade data you provide. Results are only as accurate as the input data. TaxWiseTrader is not liable for any errors resulting from incorrect or incomplete trade data provided by users.

⚠️ Broker API sync and certain AI features are currently in demo/beta mode and may not reflect live data. These features are clearly labelled in the interface.

6. Subscriptions and Billing

Paid plans are billed as described on the Billing page. All prices are inclusive of applicable GST. Refunds are processed per our refund policy. We reserve the right to modify pricing with 30 days’ notice.

7. Prohibited Use

You may not: (a) attempt to reverse-engineer or tamper with the Platform; (b) use the Platform for illegal purposes; (c) share account access with third parties; (d) submit false or misleading trade data to manipulate calculations.

8. Limitation of Liability

To the maximum extent permitted by applicable law, TaxWiseTrader’s total liability to you for any claim arising out of or relating to the Platform is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. You may cancel your account at any time via Settings. On termination, your data is soft-deleted and permanently purged after 30 days.

10. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.
